The NBA legend Tells Court He Felt No Fear of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared operational insights of his racing venture, saying he put in $40 million of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters vying for a glimpse or a photo of the sports legend.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.
At issue for Jordan and Heather Gibbs, who testified before Jordan, are details from last September. Gibbs described a hectic and tense six hours where the sanctioning body told teams they had to sign a contract extension. The document consists of 112 pages detailing team compensation and a guaranteed spot in Nascar-sponsored races.
A Refusal to Sign
Jordan explained that his team and its ally concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar refused to engage, Jordan said.
The Ultimate Motivation: Victory
But in the end, the pushback against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Success.
“Hamlin persuaded me adding a third car improved our chances to win,” he said, sharing that he purchased another franchise last year for $28m despite the uncertainty. “So I dove in.”
Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, which she said a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.
According to her, the team founder first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. The response was, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
