Federal Court Mandates Freedom of Abrego Garcia from Immigration Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the court noted that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Case
The court challenge involve disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
Terms of Release
The court, who was hearing his challenge to deportation in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
This ruling represents a notable turn in a complicated legal case featuring allegations of wrongful detention and contested gang affiliations.
